BREAKING: Trump gets news he's dreaded in court

you're watching the legal breakdown so

Glenn we finally got the news that we've

been waiting for on Donald Trump's gag

order violation but first just a

reminder for those watching right now

Glenn and I will be doing comprehensive

coverage of every day of Donald Trump's

criminal prosecution in Manhattan so if

what judge Maran just imposed against

Trump in the courtroom you know Brian we

we seem to have a lot of disappointments

when it comes to folks holding Trump

accountable this is actually a big deal

and here's why it's a big deal judge

Maran has found that Donald Trump

committed the crime he violated New York

state law by uh being in contempt of

court nine times nine counts that's nine

violations of New York state law why is

that important well first of all it's

not important as a result of the

sanctions that judge Maran imposed he

imposed the maximum money fine $1,000 on

each count in fact in his8 page written

order he comments that he knows that's

not enough to deter Donald Trump's

conduct um but nine counts of criminal

contempt $1,000 fine on each for a total

of $9,000 but really even more

importantly he said basically I'm going

to summarize here and then I actually

want to read a very short uh excerpt

from the judge's order he said listen

next time you're going to be looking at

jail time keep it up my words not his um

but what I want to do is just read a

couple of sentences from his order

because you know these are actually

historic words a former president of the

United States has just been held in

criminal contempt in his own own

criminal trial for willfully violating

court orders and here's what judge Maran

says he says the court finds defendant

Donald Trump in criminal contempt for

willfully disobeying a lawful Mandate of

this court in violation of New York

state law on separate occasions and then

here's what judge mang goes on to say

while $1,000 May suffice in most

instances to protect the Dignity of the

judicial system to compel respect for

its mandates and to punish the offender

for disobeying a court order it

unfortunately will not achieve the

desired results in those instances where

the condemner that is the person in

contempt can easily afford such a fine

in those circumstances

it would be preferable if the court

could impose a fine more commensurate

with the wealth of the contor in some

cases that might be $2,500 in other

cases it might be

$150,000 because this court is not

cloaked with such discretion it must

therefore consider whether in some

instances jail may be a necessary

punishment and then he goes on to put

again sport is my editorial Edition not

the word chosen by judge Maran Glenn

some frustrated folks are asking why

even bother with this perun step of

finding him $99,000 he himself said that

it wasn't enough why not just throw him

in jail to start with because it's an

incremental step I've dealt with

defendants who were repeatedly violating

court orders or conditions of pre-trial

release which we're going to touch on in

a minute and judges all always do it

incrementally for better or worse they

want to give the defendant every benefit

of the doubt to come into compliance and

to stop the shenanigans so ordinarily

this is how it plays out the first

violation the judge will give them a

Stern warning the second violation the

judge May uh uh fine them monetary fines

and the third violation that's when the

judge is very likely to order somebody

into some period of incarceration it is

just the way of the criminal justice

World For Better or Worse some say it

breeds a little bit of disrespect if you

willfully violate court orders and you

know you can get away with it once and

maybe twice if you can afford the fine

as a former career prosecutor I'm not

enamored of the way the courts go about

enforcing their orders but it it is just

the way of the Criminal Justice System

okay so has Donald Trump now violated

the conditions of his release in DC and

the other jurisdiction

um where he was told that he wasn't

allowed to commit federal state or local

offenses while on release and now we

know that he's committed criminal

contempt he is absolutely in violation

of the conditions set by other judges

because Donald Trump as you'll recall

has not won but four pending criminal

cases he's on pre-trial release in all

four and the judges in those cases said

you have to comply with court orders and

you can't violate the laws of any state

any locality or any federal laws he has

now squarely definitively and inarguably

violated New York state law and judge

Maran after a hearing as required under

New York state law um found him guilty

in essence Beyond a reasonable doubt

that is the evidentiary standard that is

to be applied to violation of violations

of court orders in New York so this is

absolutely a violation of Donald Trump's

pre-trial release conditions in his

other criminal cases of course that begs

the question what does that mean what

might happen to him as a result I don't

want to be cynical and I don't want to

be defeatist and say nothing is likely

to happen to him I do think each judge

will at least be obliged to take it up

to discuss it to issue what's called a

show cause order directing Donald Trump

and his lawyers when they are available

of course they're in trial in New York

right now to appear before the judges in

those other cases in which he's on

pre-trial release and and answer some

questions and perhaps have some

sanctions imposed up to and including

being revoked on pre-trial release when

somebody's on pre-trial release in a

felony case Brian and that person

violates the law of another jurisdiction

ordinarily I I don't know what the

numbers are but in a super majority of

of the cases that person will be revoked

on pre-trial release why because the

defendant has shown that he's unwilling

or unable to abide by the conditions of

release set by the judge and that

warrants pre-trial detention revocation

of his pre-trial release status will any

of the other judges do it I think it

unlikely but again these are building

blocks you know Donald Trump will begin

falling one conviction at a time and

this is just the first step in his

ultimate fall now is the onus right now

on the judges on Judge cannon on Judge

mck on um on on Judge chuin or is the

onus on the prosecutors on fonny Willis

and Jack Smith to go ahead and bring

forward uh these show cause orders Brian

that's a great question the onus is on

both or I would say the opportunity is

on both here's what I mean by that when

I was a prosecutor and I had somebody on

pre-trial release in a felony case if I

got wi that they violated a condition of

the release I would file a motion with

the court asking the court to set a show

cause hearing why the defendant

shouldn't be revoked on pre-trial

release and detained pending trial

however maybe I didn't get wind of it

maybe it was one of the Court

supervision officers um that was

monitoring or overseeing the pre-trial

release that had been set by the judge

maybe that person got wind of it that

person could then notify the judge and

you know what happened in that instance

I would get a a motion in my inbox

actually a notice from the court back in

the day when we got paper in our inboxes

and it would say the court has been

notified of a possible violation of

pre-trial release for defendant so and

so and I have set a show cause hearing

that might be the first I got wind of it

so the point is both the judge and the

prosecutor

have I think the responsibility and

certainly the opportunity to now pursue

um holding Donald Trump accountable for

his violation of pre-trial release okay

well all eyes will be on these

prosecutors these judges in these other

cases meanwhile going back to Manhattan

walk us through the process of what a

subsequent violation of Donald Trump's

gag order would look like now in this

case yeah so it's interesting because

there are actually four more alleged

violations that Alvin Bragg's

prosecutors have filed notice of so this

was only the first resolution of the

first 10 alleged violations there are

four more in the shoot and another

hearing will be held in the coming days

I'm interested to see if judge Maran

feels like he's just sort of batching

these together with the nine violations

that he just found or if he will kind of

use this next hearing to up the anti a

little bit my suspicion is because

before he made the ruling today all I

think 14 total because he only found

nine out of the 10 violations today um

all 14 are going to be viewed as kind of

the same batch and I think he is very

likely to impose perhaps four more

thousand fines when he moves on to the

second contempt hearing but what will

happen Donald Trump will continue to

push the envelope about that I have no

doubt and I have had this sneaking

suspicion all along that Donald Trump

may push the envelope one post at a time

right saying or doing one thing that

violates uh the the gag order that would

represent another contemp of Court

charge just so he will see if judge

Bashan puts him in a jail cell albeit

fleetingly maybe for a day maybe only

for an hour in the jail cell um that is

behind the courtroom where detained

defendants who are in trial are held

between active Court sessions and then

Donald Trump will come out and he will

say I went to jail for you and tell his

supporters to continue to empty their

pockets and send him their hard-earned

money they fall for it over and over and

over again here's the other sneaking

suspicion I have about why Donald Trump

may want to spend some minimal time in

jail because then his next Battle Cry

will be you see the Deep State and the

radical Democrat judges and prosecutors

wanted so desperately to defeat my

candidacy for the presidency they even

put me in a jail cell and he will blame

his upcoming and inevitable election

loss on the fact that you know the

forces of evil in his worldview the

Democrats put him in a jail cell that

will all be pure BS obviously but the

one thing we know is Donald Trump will

always blame others for any and all

losses he suffers yeah perfectly put I

mean that's been a recurring theme

throughout this entire process Donald

Trump is on trial because of his own

actions in all of these cases nobody

forced him to uh falsify business

records nobody forced him to steal

classified documents nobody forced him

to try to block the certification of the

election results no one forced him to

try to get Brad raffensberger to find

11,780 non-existent votes in in case

after case after case he is being

prosecuted as the direct result of his

own conscious decision to commit these

crimes and yet all the while he's

pointing at everybody else but the only

person who's responsible which is

himself let's finish off with this Glenn

talk about what judge michon said with

regard to Donald Trump posting other

people's words because it doesn't look

like uh this little loophole that Trump

had hoped it would be is actually

working out Brian I I would um urge our

viewers to read this eight-page order

it's a quick easy read from Judge Maran

and he completely shoots down Donald

Trump's claim that I'm just reposting

stuff even if I do add a few of my own

words my own spin on it because then

judge Maran recites chapter and verse

Donald Trump's incessant bragging about

how every word he posts on social media

blows up and everybody takes it

seriously and that's why I post it and

then it kind of contradicts his notion

that it was just a repost so kind of

it's kind of perfect for him because

it's kind of like he tries to have it

both ways one of the crimes that he that

he's being prosecuted for is where he

tries to have it both ways and he says

and he devalues his assets when it comes

time for taxes and he inflates his

assets when it comes time to uh to his

you know his net worth and and trying to

secure favorable loans and so he always

tries to have it both ways and that's

what he's doing here as well yeah I mean

his stock and trade is you know not only

deception and conniving and lying it's

bait and switch it is a plener absence

of consistency from one day to another

with regard to what he says one minute

to another one word to the next you know

the man is a walking breathing

contradiction Glen that was perfectly

put we'll leave it there again as I
